KAERCHE JEWELRY offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

The following terms and conditions shall apply for all contracts between the customer and KAERCHE JEWELRY about the delivery of goods, which are ordered in KAERCHE JEWELRY online shop under the website www.kaerchejewelry.com.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Editor X. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

These terms and conditions govern your use of our website and your purchase of any jewelry products on our website. By using our website and purchasing our products, you agree to be bound by these terms and conditions. Please read them carefully.

No person under the age of 18 years may purchase Goods. If you are under 18, please confer with an adult to make your purchase.We reserve the right to refuse service or transaction to anyone for any reason at any time.

These terms and conditions apply: so far as the context allows, to you as a visitor to Our Website; and in any event to you as a buyer or prospective buyer of our Goods. We will accept your order by way of email confirmation. That is when our contract is made. Our email will also confirm details of your purchase and tell you when we will dispatch your order. We may change these terms from time to time. The terms that apply to you are those posted here on Our Website on the day you order Goods. If in future, you buy Goods from us under any arrangement which does not involve your payment via our Website, these terms still apply. Your account with us you agree that you have provided and will continue to provide accurate and complete information about yourself. We require this information to provide you with the Goods that you order.

PRICES AND PAYMENT

We endeavour to keep our website prices updated and accurate, though from time to time there may be inaccuracies on price. In this case, we will not send your order until you have confirmed that you accept the new price. Prices for our products are subject to change without notice. Banking charges by the receiving bank on payments to us will be absorbed by us. All other charges relating to payment will be absorbed by you. Shipping costs are not included. All of our products are handcrafted, most pieces are made to order and will need to be pre-ordered as stated in the product page which takes around 10-15 working days to complete. Delivery Goods will be dispatched within 1-2 working days once the product is completed. We ship all orders through registered, recorded delivery, and are happy to help with any urgent delivery requests. You must ensure that someone is present to accept delivery. We do not cover customs and duty payments for orders outside of Thailand. Goods are sent at our risk until signed for by you or by any other person at the address you have given to us.

Whilst we do not accept returns, we are happy to exchange any item within 7 days of delivery. Unfortunately, we are unable to offer exchange on earrings. Please do contact us if you would like any information about a particular piece, whether it be further images, or if you would like to arrange a private preview or an appointment at our atelier. Sale items are not eligible for refund or exchange, unless the item in question is faulty. In the case the goods are faulty: you must inform us by email to info.kaerche@gmail.com including all details of the order and defect or other reason for return. The Goods must be returned to us as soon as any defect is discovered. So far as possible, Goods should be returned: with both goods and all packaging as far as possible in their original condition; securely wrapped; including our delivery slip; marked as 'Return' (external packaging); at your risk and cost.

We reserve the right, at our sole discretion, to update, replace or make changes to our Website, the Content, or to any of the Goods, at any time and without prior notice. In no case shall we be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product).

We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in: text, graphics, logos, icons, images, digital downloads, data, and software. We also claim copyright in the designs and compilation of all Content of Our Website. Title and ownership rights will remain the sole property of us and we will strongly protect those rights in all countries and territories. Except as set out below, you may not copy, modify, publish, transmit, transfer, sell, reproduce, derive works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part. You may not use our name, logos, trademarks or any other Content on any website of yours or that of any other person. Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not electronically store a significant portion of any Content. In certain circumstances and only if published credit to KAERCHE JEWELRY (and KAERCHE JEWELRY's relevant social handle) is given, you may share promotional imagery found on pacharee.com through social and other channels. You may not adapt, alter or create a derivative work from any pacharee.com content or imagery prior to sharing, without prior written permission of KAERCHE JEWELRY.

INDEMNITY

Where we provide goods or services without specific charge to you, then it is deemed to be provided free of charge, and accordingly, there is no contractual nor other obligation upon us in respect of those goods or service nor shall we confer any benefit or obligation on any third party. In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions. We are not liable for any breach of our obligations resulting from causes beyond our reasonable control. The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation. Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the Swiss laws. This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded. Definitions In this agreement: “Carrier” means any person or business contracted by us to carry Goods from us to you. “Consumer” means any natural person who, in connection with this agreement, is acting for purposes which are outside his business. “Our Website” means the entire computing

BESPOKE PRODUCTS (MADE-TO-ORDER)

“Bespoke jewellery” means any item of jewellery that is created by us in accordance with the customer’s specifications, or an original model that is customised based on the customer’s input. Special terms and conditions apply to such purchases. KAERCHE JEWELRY reserves the right to revise the terms and conditions at any time. Users are responsible for keeping themselves updated on any changes. By placing an order for bespoke or engraved jewellery, you confirm that you have read and accepted the below Terms and Conditions and our Privacy Policy.

1. The design process and production begin after the customer has pre-paid the full amount. Payment should be made by VISA, Mastercard or PayPal through a payment link provided by KAERCHE JEWELRY.

2. The time of delivery will vary depending on the complexity of the item, and the time required by KAERCHE JEWELRY and the maker to create the jewellery. Delivery time will be agreed with each individual customer. Delays may occur for different reasons, but we do our best to keep the customer informed about changes in the schedule. KAERCHE JEWELRY shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control (i.e. delays in transportation by DHL or other external providers.)
3. Bespoke and engraved items are considered special orders and they are not eligible for returns or exchanges. If the damage or error was present upon arrival KAERCHE JEWELRY reserves the right to repair or adjust the product so it fits with the initial agreement with the customer. A resizing / alteration service is available (depending on the item and technique in question.) This service may incur a fee. If we are not measuring your ring size for you, we strongly recommend that measurements are taken by a professional jeweller. KAERCHE JEWELRY is not responsible for any inaccuracy with regards to measuring and sizing.

4. Once an idea (manifested in an image/sketch combined with written correspondence) has been agreed on, the client has to honour this agreement. KAERCHE JEWELRY cannot be held accountable for changes to personal views on the original idea after work on the piece has commenced. We will match the idea/sketch as closely as possible when translated into your jewelry item, but please bear in mind that any sketches are just an indication of how the finished jewelry will look. Since the jewelry is hand-made, some variations from the sketch to the final, finished item can occur.

5. Necklaces and bracelets are sold in the lengths specified on our website. Custom lengths are available on request for most designs. There may be a charge involved for the extra materials used. Where this is the case, you will be informed before any work is undertaken.

6. The contract of sales is concluded when you accept these Terms and Conditions and pre-payment has been received by KAERCHE JEWELRY. Our Terms and Conditions are available on our website for your reference at any time.

7. We are unable to accept cancellations on bespoke, customised or personalised orders already in production. We reserve the right to refuse a refund or exchange on goods ordered in error.
